The Form Factory // Terms of Sale
Introduction. These terms cover any transactions where Adriaan Venter t/a The Form Factory ("we") provide goods to you ("the customer") through this website.
The Parties. The vendor is Adriaan Venter t/a The Form Factory. You are the customer.
Nature of Goods (Hardware Only). You acknowledge that System 01 and related products are sold as hardware-only kits.
Timber: We do not supply timber/dowels. You are responsible for sourcing appropriate timber (e.g., 22mm dowels) and ensuring it is of sufficient quality and strength for your intended use.
Installation: We are not liable for damage or failure caused by the timber you select, poor installation, instability of your desk/wall surface, or overloading the system beyond reasonable limits.
Orders. You place orders with us on the following basis:
You promise that you have the legal capacity to enter into the transaction;
We only conclude an agreement when we dispatch our goods to you;
We may cancel any order, but we will refund any money you have paid if we do.
Goods & Delivery. We sell the goods to you on the following basis:
Delivery: We will do our best to dispatch goods within our stated lead times. If we are unable to deliver within 30 days, you may cancel the order for a full refund.
Risk: Risks related to the goods pass to you on delivery.
Ownership: Ownership in the goods passes to you on payment of the fees in full.
Lifetime Parts Warranty. We stand behind our engineering with a lifetime warranty on all 3D printed components.
Manufacturing Defects: If a printed part fails due to a manufacturing defect (e.g., layer separation or structural cracking under normal use), we will provide a replacement part free of charge. You are responsible for shipping costs.
Accidental Damage (At-Cost Support): If a part is broken due to accident, misuse, or negligence (e.g., drops, pet damage, overloading), we offer an "At-Cost" replacement service. We will reprint the specific damaged component for the cost of raw materials and electricity, plus shipping.
Exclusions: This warranty applies strictly to the 3D printed components manufactured by The Form Factory. It does not cover third-party materials (such as wooden dowels) or cosmetic wear and tear.
Returns. You may return undamaged, unused goods within 7 days of delivery for a refund. Return shipping costs are for your account unless the item is defective.
Your Data. You own all your data. When you enter your data into the system, you give us a licence to use it to provide the goods (e.g., shipping details).
Intellectual Property. We own all intellectual property rights in our designs and goods. You may not copy, reverse engineer, or reproduce our designs for commercial purposes without our permission.
Disclaimer. We disclaim all warranties to the extent allowed by applicable law. We are not liable for any defect that you cause through misuse, modification, or improper assembly.
Fees and Payment. You will pay us the fees on the due date.
Direct Damages Limited. Our maximum liability to you for all claims related to these goods is limited to the total amount of fees that you have paid us for them.
Indirect Damages. We will never be responsible for any indirect or consequential damages (e.g., if a shelf fails and damages your monitor, we cover the shelf, not the monitor).
Resolving Disputes. We want to avoid disputes. If there is one, the parties must first try to negotiate to end the dispute. If negotiation fails, the parties agree to the jurisdiction of the Magistrate's Court or Small Claims Court in Cape Town.
Notices. We choose our respective email addresses as our primary communication channel for legal notices.
Governing Law. South African law governs this agreement.
